A woman who’s in labor is counting on her medical team to keep her and her baby safe. While most women will have attentive and alert caregivers, some will have to do deal with a negligent doctor, nurse or midwife. In those cases she or her baby can suffer considerable harm.
There is no reason for a woman who was the victim of negligence to have to be the one who pays the costs for that negligence. Instead, the party who harmed her and others might be held accountable to cover those costs.
Birth injuries can range from mild to fatal, depending on what happened. In many of these cases, the woman or newborn will need additional care to address the injuries. This might involve more time in the hospital, additional tests or unexpected treatments. In all of these cases, the victim shouldn’t be held financially accountable.
The need to seek compensation in these cases may go far beyond the need to cover the increased care costs. Missed wages and similar damages might also come about in these cases. Turning to a lawsuit to get those covered might be necessary.
